الوساطة ودورها في حل النزاعات الدولية

الملخص:

هدف هذا البحث إلى بيان ماهية الوساطة بإيضاح مفهومها وأهميتها وأنواعها ومميزاتها وركائز نجاحها، كما تم بيان الأساس القانوني للوساطة، من خلال الوقوف على ما أوردته مختلف المواثيق والمعاهدات الدولية التي حثت على اللجوء للوساطة؛ باعتبارها آلية من آليات الدبلوماسية الوقائية لحل النزاعات الدولية سلميًا، كما تم إظهار دور الوساطة ونجاحها، من خلال الأمثلة والنماذج العملية التي كانت الوساطة طريقة التسوية التي تم اللجوء إليها لحل تلك النزاعات، وذلك بسلوك مناهج البحث العلمي المتمثلة بالمنهج الوصفي والتحليلي والقانوني.

وخلص البحث إلى نتائج عدة تمثلت في أن الوساطة آلية مهمة لحل مختلف النزاعات والحد من انتشارها واتساع دائرتها، سواء تمت قبل تطور الخلاف إلى صراع، أم في أثناء النزاعات المسلحة لإيقافها، وتبرز أهميتها من خلال التأكيد على اللجوء إليها في مختلف المواثيق والمعاهدات الإقليمية والعالمية، كما توصل البحث إلى أن الوساطة غير ملزمة لجميع الأطراف، سواء من حيث قبولها كوسيلة لحل النزاع، أم من حيث قبول نتائجها التي تم التوصل إليها، كما أن شخصية الوسيط تؤدي دورًا مهمًا في تحقيق هدف الوساطة، وينبغي أن تكون مقبولة لأطراف النزاع، وتتصف بالنزاهة والحياد، وتتسم بمجموعة من المهارات والسمات، التي تساهم بنجاح دوره في رأب الصدع بين أطراف النزاع.

وأوصى البحث بضرورة الاهتمام بآلية الوساطة وتفعيلها لحل مختلف النزاعات، وتنظيم إجراءات الوساطة بطريقة قانونية، وبلورة نتائجها على شكل اتفاقيات ومعاهدات دولية بين أطراف النزاع؛ لتكون أكثر فاعلية ونجاح، كما أوصى البحث بتطوير المراكز الخاصة بتدريب الوسطاء وتطوير مهاراتهم؛ ليسهموا في إنجاح عملية آلية الوساطة التي تؤدي بدورها إلى الإسهام في الحفاظ على السلم والأمن الدوليين.

:Abstract

The aim of this research is to clarify the essence of mediation by explaining its concept, significance, types, features, and the foundations of its success. The study also presents the legal basis of mediation by examining what various international charters and treaties have stated in encouraging the resort to mediation—considering it a mechanism of preventive diplomacy for the peaceful resolution of international disputes. In addition, the role and success of mediation were demonstrated through examples and practical models where mediation was the method used to resolve those conflicts. This was achieved by employing the methodologies of scientific research, namely the descriptive, analytical, and legal approaches.

The research concluded with several findings, primarily centered on the fact that mediation is an important mechanism for resolving various disputes and curtailing their spread, whether it is employed before a disagreement escalates into a conflict or during armed disputes to halt their progression. Its importance is underscored by its endorsement in various regional and international charters and treaties. The study also found that mediation is not binding on all parties—neither in terms of accepting it as a means of resolving the conflict, nor in terms of accepting the outcomes that are reached. Furthermore, the personality of the mediator plays an important role in achieving the objective of mediation; the mediator must be acceptable to the conflicting parties, characterized by integrity and neutrality, and possess a set of skills and attributes that contribute to successfully bridging the gap between the disputing parties.

The research recommended the necessity of paying attention to the mediation mechanism and activating it to resolve various disputes, organizing mediation procedures in a legal manner, and crystallizing its outcomes into international agreements and treaties among the conflicting parties so that it becomes more effective and successful. Additionally, the study called for the development of centers dedicated to training mediators and enhancing their skills, to contribute to the success of the mediation mechanism which, in turn, plays a key role in maintaining international peace and security.
