الوسائل الضبطية والجزائية لحماية البيئة في القانون اليمني

يهدف هذا البحث إلى التعرف على النظام الضبطي والجزائي الخاص بحماية البيئة في القانون اليمني. وتتلخص إشكالية البحث في السؤال الآتي: ما الوسائل القانونية الضبطية والجزائية التي اتخذتها الجمهورية اليمنية في سبيل حماية البيئة؟

تم استخدام المنهج الوصفي التحليلي في هذا البحث، وتم تقسيم هذا البحث إلى ثلاثة مباحث، كان المبحث الأول للوسائل الضبطية لحماية البيئة، فيما تم تخصيص المبحث الثاني للوسائل الجزائية لحماية البيئة، أما المبحث الثالث فقد عُني بالجزاءات المدنية على الأضرار البيئية.

وأخيرًا الخاتمة التي اشتملت على أبرز النتائج التي خلصت إلى كفاية النظام الجزائي والضبطي المقرر في القانون اليمني لحماية البيئة. ومن ثم أهم التوصيات التي تتمثل في وجوب حرص المشرع اليمني على استيفاء بعض جوانب النقص التي لا زالت تعتور المنظومة العقابية المتعلقة بحماية البيئة وتحقيق التنمية المستدامة.

:Abstract

This research aims to identify and evaluate the disciplinary and penal system for environmental protection in Yemeni law. The research problem is summarized in the following question: ‘What are the legal regulatory and penal means adopted by the Republic of Yemen in order to protect the environment?’. The analytical-descriptive research method is adopted in this research, which is divided into an introduction, followed by three sections and a conclusion: the first section, addresses the disciplinary means for environmental protection, the second section, is devoted to the penal means for environmental protection, and the third section, deals with civil penalties for environmental damage. The conclusion of the research includes the results and recommendations. The most important result of the research is that: the sufficiency of the penal and disciplinary system stipulated in Yemeni law for environmental protection, whereas, the most important recommendation of the research is that: The Yemeni legislators must be keen to address some of the deficiencies of the penal system related to environmental protection and achieving sustainable development.
